The accident happened around 7:30 p.m. on Saturday, May 31, at the intersection of Hill and Colorado. The adults he was walking with were not injured. The boy was crossing at the crosswalk while the truck made a right turn. Both parties were obeying traffic laws.

After the child was struck, the driver stopped and stayed at the scene until police arrived. He offered to give blood and urine samples to prove that he was not under the influence at the time of the accident. Police say they don’t anticipate the driver will be charged.

In California, the penalty for hit and run varies based on the level of injury to the victim. But first, prosecutors have to prove a few things: That the driver was aware they were in an accident, that they knew someone was injured, and that the person intentionally violated the legal requirements for staying at the scene of an accident.

In this case, police say the driver was not under the influence and that it appears he simply just did not see the child in the crosswalk. However, if he had left the scene, he could be charged with hit and run even though the accident did not appear to be his fault. The driver in this case obeyed the legal requirements for being involved in an accident, including staying at the scene and rendering aid or notifying police.
