Can I get a DUI while Taking Prescription MedicationsIn California, you can be charged with DUI even if you have never taken a drink in your life. How? By driving under the influence of over-the-counter, prescription, or illegal drugs.

DUID, or driving under the influence of drugs, can be much more difficult for an officer to prove than a DUI with alcohol. That’s because there’s no solid percentage at which it’s illegal to drive when it comes to drugs. DUID is proven only with circumstantial evidence observed by the officer—your appearance, your performance on a field sobriety test, your behavior and your driving patterns. A blood or urine test can be administered to test for substances, but there is no concrete field test for drugs.

If you are suspected of driving DUID, an officer can call in a DRE, or drug recognition expert. These are officers trained in recognizing behavior and physical clues indicating the presence of drugs. They simply observe your behavior and save their findings to present in court as testimony.

If you are charged with DUID, in many ways the charge is similar to a DUI, except that there’s no concrete threshold as in with the BAC limit. For a first-time offense, you can receive a $390 fine, 3 to 5 years informal probation, 6-month license suspension, one year in county jail, three months of drug education classes.
