County Bans Outdoor Marijuana Gardens

santa ana marijuana defense attorneyVoters in Lake County approved a restriction on outdoor marijuana growing in late June.


Lawmakers had already approved an ordinance, but medical marijuana supporters collected enough signatures to put the restriction to a vote so the public could decide. Supporters of the ban claimed that marijuana growers were polluting local forests and damming creeks to raise their crop. Opponents of the ban said that the lawmakers were confusing legal growers with illegal growing, and that the new restrictions would be ineffective and hard for police to enforce.


The new Lake County ordinance bans growing marijuana outdoors bans outdoor grows within the community growth boundaries, within 1,000 feet of schools and parks, within 100 feet of bodies of water, and limits indoor growing to 100 square feet or less.


A local medical marijuana advocacy group, the Community Alliance to Ban Illegal Cannabis Cultivation, is working on it’s own medical marijuana ordinance for the November ballot that they say will be clearer and easier to enforce, while not forcing those who want to grow medical marijuana to have no choice but to do so illegally.


SB 420 and Prop 215 made growing and using medical marijuana under the supervision of a physician legal in the state of California, but local municipalities are also free to make their own rules regarding the cultivation and use of medical marijuana.
