In California, the penalty for leaving the scene of an accident, or hit and run, varies based on the level of injury or damage sustained by the vehicle. But first, prosecutors have to prove a few things: That the individual charged was actually aware they were in an accident, that they knew someone was injured or that property was damaged, and that the person intentionally violated the requirements for staying at the scene of an accident.

Penalties for hit and run vary from 90 days in jail to 4 years in state prison. There are many factors that can affect your sentence, including if you are under the influence at the time of the accident; how many people are injured in the accident; if you tried to get help for the victims, like administering CPR or calling 911; if it can be proved you were driving recklessly at the time; if you came forward voluntarily and the state of your current driving record.
