Irvine California criminal defense attorneyAn Anaheim man is being held on several charges after a car accident that resulted in the death of an Irvine woman. Police say the man was fleeing the scene of another accident when he broadsided the victim.

Brandon Alvarez was suspected of driving drunk when he struck a car at harbor Boulevard and Date Place in Costa Mesa. The driver suffered minor injuries. He attempted to flee the scene in his Nissan Pickup when he t-boned another car coming off the northbound 405 off-ramp.

The female driver of the 2013 Kia Optima was killed in the crash, and a male passenger was taken to the hospital. Alvarez tried to leave the scene of the accident on foot, but was arrested by police. He faces DUI, hit-and-run and vehicular manslaughter charges.

In California, those convicted of gross vehicular manslaughter while intoxicated face state prison for up to 10 years and up to a $10,000 fine. Conviction for vehicular manslaughter while intoxicated results in one year in county jail, or up to 4 years in state prison, and up to a $10,000 fine. The difference between the two charges is the amount of negligence shown in the act–acting in a manner that will most certainly result in injury or death to someone, not just being careless.
