Santa Clara County Bans Medical Marijuana Dispensaries

The Santa Clara County board of supervisors decided in an August 12 vote to ban medical marijuana dispensaries from operating in the county. The move isn’t a permanent one, but blocks dispensary business from being conducted in the county until supervisors can make a long-term decision regarding medical marijuana on September 25.


San Jose recently nearly banned dispensary operations, making nearly 90 percent of the city off limits to them under new zoning regulations. That prompted Santa Clara County officials to take action, since they worried that dispensary operations would move into unincorporated Santa Clara County. Local law enforcement and environmental agencies have blamed illegal marijuana farming in rural areas for the depletion of water resources, deforestation, and salmon die off.


The new restrictions make it harder for medical marijuana patients to find marijuana, which county officials think is a good thing. They say that by restricting operations, they are limiting access to marijuana for the youth in Santa Clara.


This is another huge blow to proponents of medical marijuana after legislation that would license and regulate marijuana dispensaries stalled in the California assembly and likely won’t see any movement until next year. Senate Bill 1262 would have created a regulatory agency, licensed dispensaries, and provided guidelines for the cultivation, processing, distribution and labeling of medical marijuana and marijuana products.
